《合肥市经济适用住房管理办法》已经2005年3月10日市人民政府第49次常务会议审议通过,现予发布,自2005年5月1日起施行。

合肥市经济适用住房管理办法
第一条 为规范经济适用住房建设、交易和管理,解决城市中低收入家庭的住房困难,根据国家有关规定,结合本市实际,制定本办法。
第二条 本办法所称经济适用住房,是指政府提供政策优惠、限定建设标准、明确供应对象、核定销售价格,具有保障性质的政策性商品住房。
第三条 本办法适用于本市市区范围内经济适用住房建设、交易和管理工作。
第四条 市房地产行政管理部门负责本市经济适用住房的管理工作,其所属的市经济适用住房建设发展管理机构(以下简称市经济房管理机构)具体负责日常工作。
发展计划、国土资源、规划、建设、价格、民政等部门按照各自的职责,负责做好经济适用住房管理的有关工作。
第五条 市房地产行政管理部门会同发展计划、规划、国土资源等部门在做好市场需求分析和预测的基础上,编制本市经济适用住房发展规划,报市政府批准后实施。
第六条 市发展计划部门会同建设、规划、国土资源、房地产等部门依据经济适用住房发展规划和项目储备情况,编制经济适用住房年度建设计划和用地计划。经济适用住房建设用地纳入年度土地供应计划。
第七条 经济适用住房的开发建设享受以下优惠政策:
(一)建设用地以国有土地使用权划拨方式供应;
(二)建设和经营中的行政事业性收费优惠征收(优惠征收的费用项目和标准见附表);
(三)建设项目小区外基础设施建设费用,由政府承担。
第八条 经济适用住房建设单位可以以在建工程向商业银行申请抵押贷款。
第九条 购买经济适用住房的个人向商业银行申请贷款的利率,执行中国人民银行公布的贷款利率。
住房公积金贷款应当优先向购买经济适用住房的个人发放。
第十条 经济适用住房开发建设按照政府组织协调、企业市场运作的原则,实行项目法人招标,参与投标的房地产开发企业必须具有与开发建设规模相适应的资质、资本金、良好的开发业绩和社会信誉。
经济适用住房项目法人招标工作由市房地产行政管理部门组织,市经济房管理机构具体负责,市政府相关职能部门参加,按照国家有关规定组织实施。
第十一条 经济适用住房规划设计应当坚持布局合理、规模适中、功能齐全、配套完善的原则,分为大、中、小套型,其中大套住房面积控制在建筑面积80平方米左右,中套控制在建筑面积60平方米左右,小套控制在建筑面积40平方米左右。
城市危旧房改造及市政重点工程建设中实行货币补偿的被拆迁人,其购买的经济适用住房每套面积控制在建筑面积110平方米以内。
第十二条 经济适用住房建设工程竣工时,建设单位应当按照规定组织验收,相关部门按照国家和省、市的有关规定予以备案。
第十三条 经济适用住房建设单位对其开发建设的经济适用住房工程质量负最终责任。
建设单位应当向买受人出具《住宅质量保证书》和《使用说明书》,并按有关规定和合同约定承担保修责任。
第十四条 经济适用住房销售价格,由市价格部门会同市房地产行政管理部门审定后公开发布执行。
第十五条 经济适用住房预售实行许可制度,预售条件及预售许可证的办理程序按照有关规定执行。
第十六条 经济适用住房实行购买人申请、主管部门审核批准,并将购买人情况向社会公示的制度。
第十七条 符合下列条件的家庭,可以申请购买经济适用住房:
(一)家庭成员均具有本市市区居民户口,且至少1名成员取得本市市区居民户口5年以上;
(二)家庭年收入低于政府公布的本市中低收入家庭标准;
(三)无住房或现住房人均建筑面积低于政府公布的经济适用住房购买人的居住标准。
第十八条 申请购买经济适用住房按照下列程序办理:
(一)申请人持身份证、户口簿、家庭收入证明、住房情况证明及其它证明文件向市经济房管理机构提出申请;
(二)经审查符合条件的予以公示。公示后有投诉的,由市经济房管理机构会同有关部门调查、核实。对无投诉或核实无误的,开据购房证明;
(三)购房人持购房证明到公布的经济适用住房销售单位选购经济适用住房。
经济适用住房应当优先出售给符合条件的无房户、危房户以及烈军属、残疾人、劳动模范。
除第二款优先对象以外,申请人数较多时,应当按照公开摇号等办法确定购买人。
第十九条 符合条件的家庭,可以持购房证明选购一套与核准面积相对应的经济适用住房,购买面积原则上不得超过核准面积。
购买面积在核准面积以内的,按核准的价格购买;购买面积超过核准面积的部分,不得享受政府优惠,由购房人补交差价。差价标准由市价格部门和市房地产行政管理部门会同有关部门确定。差价款由市财政部门专户存储,专项用于经济适用住房建设和管理工作。
第二十条 城市危旧房改造及市政重点工程建设实行货币补偿的被拆迁人,持身份证、户口簿、市拆迁管理部门出具的实行货币补偿确认函及购买安置房屋的建筑面积确认书,向市经济房管理机构提出申请,经审查符合条件的开据购房证明。购房人持购房证明到公布的经济适用住房销售单位选购经济适用住房。
被拆迁人每户限购一套经济适用住房。已实行房屋产权调换的不得申请购买经济适用住房。
第二十一条 经济适用住房的房、地权证中需加注“经济适用住房”和“划拨土地”字样。严禁以经济适用住房名义取得划拨土地后,改变土地用途,变相搞商品房开发。
第二十二条 经济适用住房在取得房屋所有权证和土地使用证5年后,方可上市交易。出售时,需按照届时该住房市场综合评估价的15%比例向政府交纳收益,土地使用性质由划拨转为出让。
本办法施行前已批准的经济适用住房(含集资建房),其首次上市交易的,按《合肥市已购公有住房上市交易管理暂行办法》(市人民政府令第73号)有关规定执行。
在规定不得出售的期限内确需出售的,由市经济房管理机构按不高于原供应价回购。
经济适用住房购买人以市场价出售经济适用住房后,不得再购买经济适用住房。
第二十三条 个人购买的经济适用住房在未向政府补交收益前不得用于出租经营。
第二十四条 经济适用住房小区实行物业管理,一个区域原则上应当由一个物业管理企业实施物业管理。
第二十五条 集资建房、合作建房是经济适用住房的组成部分,凡已经购买了经济适用住房的人员,不得参加集资、合作建房。
第二十六条 各有关部门应当加强对经济适用住房建设、交易中违法违纪行为的查处。
未经批准擅自改变经济适用住房用地用途的,由市国土资源部门按有关规定处罚并补办土地使用权出让手续。擅自提高经济适用住房销售价格的,由市价格部门依法进行处罚。擅自向未取得购房证明的家庭出售经济适用住房的,市房地产行政管理部门不予权属登记,并责令建设单位限期收回;不能限期收回的,由建设单位补缴同地段经济适用住房与商品住房价格差额部分,并对建设单位进行处罚。
第二十七条 对弄虚作假、隐瞒家庭收入和住房条件,骗购经济适用住房的个人,由市房地产行政管理部门责令购房人退回已购住房或按市场价补足购房款,并可提请所在单位对申请人进行行政处分。对出具虚假证明的单位,由市房地产行政管理部门提请有关部门追究单位主要领导的责任。
第二十八条 本办法自2005年5月1日起施行。原《合肥市经济适用住房管理暂行办法》(合政〔1999〕47号)同时废止。

PART II PROTECTION OF WAGES ON INSOLVENCY FUND BOARD

There is hereby established a board to be known as the Protection

The Board shall consist of a Chairman appointed under the Schedule

Review by Board
Any applicant aggrieved by any decision of the Commissioner
under
ion 16 may in writing--
request the Commissioner to give reasons for that decision; and
after being given reasons under paragraph (a),
request the
issioner to refer the application to the Board.
Upon receiving a request from an applicant under subsection (1)
(b),
Commissioner shall forward all documents relating to the
application

The Board may confirm or vary any decision of the Commissioner
on an

Additional power of Commissioner
Notwithstanding that in any particular case a petition referred
to in
ion 16 (1) (a) (i) or (b) has not been presented against an
employer,
Commissioner may, subject to subsection (2) of that section,
make an
ratia payment under that section in that case if in his opinion--

sufficient evidence exists to support the presentation of a

if the employer is a company, that he is unable to pay his debts;

Where the Commissioner exercises his discretion under
subsection (1)

Nothing in subsection (2) shall require the Commissioner to give

Verification of application
For the purpose of verifying any application under section 15,
or if
